El respeto de la voluntad de la persona protegida debe convertirse, por imperativo de la Convención de Nueva York, en eje vertebrador de todas las medidas de protección. La inaplazable reforma que debe acometer el legislador español así lo debe consagrar, pero debemos permanecer atentos a que estos cambios, enarbolando banderas comunes a todas las causas, no caigan en el error de consagrar un sistema, políticamente correcto, vacío de contenido en el que los más vulnerables de nuestra sociedad vean incrementada su vulnerabilidad. Por ello, toda reforma debe ir precedida de un trabajo de análisis que ponga de manifiesto las deficiencias del ordenamiento jurídico y proponga soluciones eficaces a los problemas detectados.Esta obra es el fruto de una reflexión colectiva de más de veinte investigadores, procedentes de diferentes universidades de España, Francia, Inglaterra, Estados Unidos, Argelia, Bélgica, Italia y Suiza, en la que se estudian las reformas que se están llevando a cabo y las que se van a realizar para adaptarse a los postulados de la Convención que exige adoptar las “medidas pertinentes” para garantizar el respeto de la voluntad de la persona, voluntad que debe situarse en el centro de cualquier medida de protección pero, eso sí, anticipando los riesgos de abuso e influencia indebida que existen, para adoptar las salvaguardias que los impidan.La reflexión que cada autor realiza desde la perspectiva de su ordenamiento jurídico, permite, con un abordaje transversal, observar el impacto de las posibles reformas en todos los ámbitos de la vida de la persona ya que se analiza su incidencia tanto en los actos de carácter personal, como el matrimonio y el divorcio o los de carácter médico, hasta los actos de carácter patrimonial como la contratación o la capacidad sucesoria, sin olvidar la cuestión de los derechos políticos, cuyo ejercicio es la mejor expresión de la participación en sociedad de todas las personas con discapacidad.
